Introductory Provisions

      When we say '$1ArtforAmerica’, we mean an art project that aims to create original works of art using painting, drawing and printmaking techniques and similar on media such as primed canvas, fine art paper, plain paper, photographic paper, and similar.
      When we say 'Artist’, we mean artists and collaborators, i.e. anyone who, in any way, intentionally or unintentionally, contributed to the creation of the 'Work of Art' – by using this term, we mean any work created by $1ArtforAmerica.
      Within the framework of artistic creation related to the creation of Works of Art as part of $1ArtforAmerica, the Artist's right to free expression in both graphic and textual form is hereby reserved, deriving this right from the right to freedom of artistic expression and freedom of speech.
      The Artist also reserves the right to criticize, in any form and to any extent, those holding public office. These individuals should be aware of the possibility of criticism and, if faced with such criticism, should deal with it themselves within the framework of their activities, especially if, in the Artist's opinion, they receive privileges and remuneration for this activity that significantly exceed their competence.

      $1ArtforAmerica creates Works of Art exclusively in Europe, defined as European Union countries (as of September 2025) and the United Kingdom, Switzerland, Liechtenstein, Norway, and Iceland. Due to personal relationships, $1ArtforAmerica allows the creation of Works of Art in Japan and Canada at any time.

      $1ArtforAmerica is not a company registered in any country, is not an organization affiliated with any association, and does not have legal personality. $1ArtforAmerica is an artistic project aimed at creating Works of Art. Due to the decision of January 30, 2025, published on its website on that date, $1ArtforAmerica does not conduct ongoing sales of Works of Art and, therefore, does not pay any taxes on its income, as it has no income. In the period preceding the decision of January 30, 2025, $1ArtforAmerica did not sell any Works of Art, did not generate any income, and did not pay any taxes, as nothing of a kind was due.

      Regardless of the creative work understood as free artistic activity, each person working together within the $1ArtforAmerica project retains separate rights to their own artistic activity, and therefore to the sale of their own works of art. Such activity, including sales, revenues, and the resulting formal, legal, fiscal, and other obligations, remain their own responsibility.

Terms of Limitation of Liability of $1ArtforAmerica

      Subject to the provisions of the paragraphs below, the aggregate liability of $1ArtforAmerica, the Artist, and/or any person who in any way, whether intentionally or unintentionally, contributes to the creation of the Work of Art under or in connection with these terms and conditions, whether arising in contract, tort (including negligence), breach of equity, breach of statutory duty, or otherwise, for any indirect or consequential loss suffered by any person or under any other circumstances, shall be limited to the one of:
      - the nominal asking price of the Work of Art as specified in the original announcement on the $1ArtforAmerica website on January 19 and 20, 2025, in the event that no actual sale of the Work of Art occurs; and
      - the nominal asking price of the Work of Art, as specified in the original announcement on the $1ArtforAmerica website on January 19 and 20, 2025, plus shipping costs if the Work of Art is actually sold.

      The above limitation also applies to the filing of a complaint against $1ArtforAmerica and/or the Artist, subject to the jurisdictional choice set forth below, alleging infringement of the complainant's personal rights against $1ArtforAmerica and/or the Artist, including claims for libel or defamation. In such cases, in addition to limiting the liability of $1ArtforAmerica, the Artist, and/or any person who in any way, intentionally or unintentionally, contributed to the creation of the Work of Art to the amounts specified above, the complainant has the following additional rights, regardless of the court's decision:
      - the complainant shall make an examination of conscience, including determining the amounts obtained illegally by the complainant at any time and under any circumstances and donating them in whole or in part to charity, and;
      - the complainant shall examine his or her conscience and confess his or her sins to the God in whom he or she believes (in the form of confession, direct confession or other form appropriate to the given religion), or;
      - if they do not believe in any God, the complainant is entitled, if the court selected by $1ArtforAmerica and/or the Artist, as defined below, finds the complaint partially or fully justified, to obtain from $1ArtforAmerica, free of charge, one Work of Art selected by $1ArtforAmerica, including the cost of shipping, provided that the shipment will be made by ordinary mail accepted by a post office in a country belonging to the European Union (as of September 2025) and/or the United Kingdom, Switzerland, Norway, or Iceland, provided that the country from which the shipment will be sent is chosen by $1ArtforAmerica or the Artist. The above excludes shipping to Mars or anywhere in outer space, and any and all alternate realities in which the complainant either permanently or temporarily resides, or;
      - if they are followers of a polytheistic religion, they shall somehow manage themselves, as we, the artists, do not feel competent in religious matters, and we would not, heavens forbid, want to violate anyone's religious feelings, beliefs, customs, restrictions, or commandments of their faith. However, so that followers of any polytheistic religion do not feel left out, we also grant them the right to obtain one Work of Art under conditions equivalent to those described above, or;
      - if they believe in in the gods of greed and self-importance together with those that worship themselves and only themselves (the ‘Me First’ brigade), we, as sensitive artists, advise them to think deeply about their current lives or/and seek treatment.

      The right to choose the appropriate court to hear any complaints regarding the activities of $1ArtforAmerica and/or the Artist and/or any person who in any way intentionally or not, contributed to the creation of the Work of Art shall be available solely to the party being sued and shall be limited solely to the European Union (as of September 2025) and Switzerland and Norway.

      Any dispute or claim (including non-contractual disputes or other claims) arising out of or in connection with these Terms shall be governed by and construed in accordance with the law of the European Union country (as of September 2025) or Switzerland or Norway chosen by the party being sued.

      Each complainant and/or their legal representative irrevocably consents to the exclusive jurisdiction of a court in European Union country (as of September 2025) or Switzerland or Norway chosen by the party being sued to settle any dispute or claim (including non-contractual disputes or other claims) arising out of or in connection with these Terms.

      If any provision or portion of any provision of these Terms is or becomes invalid, illegal, or unenforceable, it will be deemed deleted, without affecting the validity and enforceability of the remaining provisions.

      Any complaints or appeals, in any form or for any reason, must first be notified to $1ArtforAmerica at this website email: 1dollarartforamerica@protonmail.com (unless other email address is published on our website) or else they will be null and void. In such case, $1ArtforAmerica agrees to provide a written response (electronically to the return email address) within 90 days of receipt of such notice and propose mediation to resolve the dispute amicably. Mediation and the proposed settlement will be offered in a location appropriate to the country selected by the party in dispute and at a time convenient for the parties. Only if mediation fails and a settlement is reached will the complainant have the right to bring the case to court in the country chosen by the complainant in accordance with the provisions above, provided that if, between the time $1ArtforAmerica receives information about the complaint and the complainant selects the country of jurisdiction and the time the competent court sets the first hearing date, a war, martial law, suspension or restriction of freedom occurs in that country, or if an international institution with the status of a court determines that there are limitations on the proper functioning of the courts in a given country, the complainant will have the right to postpone the court proceedings until the limitations indicated above are lifted. By filing a complaint, the complainant agrees to the above conditions; otherwise, it simply proves they’re incapable of reading with comprehension and don’t understand a thing – which, ipso facto, means they can’t possibly be offended, insulted, or have their personal rights infringed in any way.

Limitation of Liability of $1ArtforAmerica – important considerations

      $1ArtforAmerica also stipulates that in its work and/or any of its elements uses the concept of licentia poetica, commonly understood in civilized countries with stable democratic systems, also known more generally as artistic license (including creative license, poetic license, historical license, dramatic license, and narrative license). It is important to emphasize that in $1ArtforAmerica's work, all content, regardless of form, is protected in accordance with the principles of freedom of speech and fair use. All content and depictions of public figures are for artistic and commentary purposes. They are not meant to state or imply actual facts, but are artistic interpretations commonly protected. This website may contain copyrighted material, the use of which has not always been specifically authorized by the copyright owner. The content is made available for purposes of artistic creation, commentary and criticism, which is considered 'fair use' under copyright law. The $1ArtforAmerica and/or Artist does not claim ownership of any third-party content used. The works of art, views and opinions expressed on this website are those of the artists working together within the project $1ArtforAmerica and do not represent the views of any other group, political party, religious organization, association or collective.

      Should any complainant and/or their legal representative ever attempt to claim that the provisions presented herein may seem amusing, argue that they considered them a joke, and thus infer a supposed right to dismiss the elements contained therein that protect $1ArtforAmerica, we recommend that they consult the abundant, truly extensive literature on humour. It's an interesting read, and we highly recommend it; broadens the horizons.
      To conclude this somewhat tiresome topic, we declare that, in exercising the rights and freedoms mentioned above many times, we are very serious – where we deem it appropriate – and sometimes we showcase our sense of humour. For various reasons: to comfort those weary of everyday life in increasingly difficult and unpredictable times, to imagine someone's smile on a sad face, but also to bring relief to those whose minds struggle with reality. We address our message to a wide audience.

Supplementary provisions

      If you’d like to share your valuable thoughts about art – or anything else, really – we’d be grateful, and trust you believe them valuable.
      If you’re tempted to insult us, kindly refrain. Unless, of course, it genuinely makes you feel better or somehow makes you a better person.
      If you’re inclined to cause us harm, please don’t. And if you feel like harming anyone or blowing anything up, we strongly urge you not to – no matter how thoroughly convinced you are that it will heal you, anyone else, or the whole of mankind.
      In such cases, as sensitive artists, we implore you: put down your weapons, stash away your dangerous tools, hand over your explosives to the authorities, and seek help. The world really can be a wonderful place!

Privacy Policy – basic

      By sending any message to this email (1dollarartforamerica@protonmail.com) – unless other email address is published on our website, users of the $1ArtforAmerica website confirm that the information they provide is true and accurate.

      If you think – or even have the slightest suspicion – that the email you’re about to send contains anything banned in any country (except Russia, North Korea and the United States of America as of 2025-29 or later), or if it might put you at risk or cause you any sort of trouble – material, mental, or otherwise – then please, do yourself a favour and hold off.
      We do not store or use the personal data of our website users. In particular, we do not use the personal data you provide for marketing purposes, nor do we archive it. Therefore, we ask that you do not provide us with any personal data, especially sensitive data. Any personal data included in your correspondence will be deleted.

      The only situation in which an email address, along with the personal data contained therein, if not already deleted by us, may be shared with authorized government agencies – only upon their request and after we have obtained confirmation, through legal consultation, that they actually have such authorization.
